Utah has some of the strictest and most confounding DUI laws in the nation. Perhaps the most frustrating and controversial of Utah's DUI laws are its DUI laws regarding drug use and the presence of a metabolite in a driver's blood.
Utah's "Any Measurable Amount" Offense
Under Utah law, a person may be convicted of Driving with a Measurable Metabolite if they have any measurable amount of drugs in their system. In fact, a person may be convicted for the presence of a drug remnant in their system, known as a metabolite. Metabolite is like the exhaust of the drug.
If you have any drugs in your system, even if you used drugs several days to weeks previous to the arrest, you could be convicted of Driving with a Measurable Metabolite. The consequences of a conviction carry many of the same penalties that an actual DUI does. To make things worse, you may be convicted even if you were taking pharmaceutical drugs.
